Sub: -Implementation of Right to Information Act, 2005.

  1. A reference is invited to Circular no. EP-25-2005-23 Dated 18.8.05 enclosing a copy of Right to Information Act, 2005.

  2. It is informed that Govt. of India has enacted “Right to Information Act, 2005” replacing the “Freedom of Information Act, 2002”.  The said Act has been published in the Gazette of India on 21st June, 05 which will come into force on 120th day commencing from 15th June, 2005.  Now from 12th October 2005 a copy of said Act along with Action plan for its implementation is enclosed.

  3. In accordance with Section 5 of Right to Information Act, 2005 as well as Hqrs. Circulars no. EP-25-2005-23-27 Dated 18.8.05 & 9.9.05 respectively,  Central Public Information Officers and Central assistant public information officers have to be designated in its each administrative offices of FCI being “Public Authority” with in the meaning of Section 2(h) of the said Act.  The following Officers in Zonal Office (North) have accordingly been designated as CAPIOs, CPIOs & Appellate Authorities for each Division.

  1. iv)  The above designated officers under the RTI Act, 2005 will receive the applications from Reception Section of Zonal Office (North) and furnish the information with in the stipulated time limit.  The Reception Section will accept the application(s) alongwith the prescribed fees under the Act and send to the above designated officers on the same day itself.

  2. v)   AGM (Computer) in Zonal Office will ensure that the name of the designated officers in Zonal Office are placed in the Website latest by 27.9.05 and will ensure that the same are updated on regular basis.  The DM (Computer) will also collect information from the concerned divisional Heads in the Zonal Office and placed the same of FCI, Zonal Office Website. 

As Right to Information Act, 2005 will come into force w.e.f. 12.10.05, the necessary arrangements / required action must be completed latest by 30th September 2005 positively.  A confirmation to this effect shall be sent to Hqrs.

It is to reiterate that under the relevant provisions of said Act, it is the responsibility of each and every official to take this task seriously and be well prepared in advance for the implementation of said Act.  A copy of Hqrs. Circular no. EP-25-2005-26 Dated 5.9.05, no. 27 Dated 9.9.05 and other circulars received from Hqrs. are enclosed for information.

 

4. As per Section-4 of RTI Act-2005, 17 manuals are required to be published by each public authority. A list of 17 manuals is given as under:-

6.

A statement of the categories of documents that are held by it or under its control.

7.

The particulars of any arrangement that exists for consultation with, or representation by the members of the public in relation to the formulation of its policy or implementation thereof.

8.

A statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils committees and other bodies are open to the public, or the minutes of such meetings are accessible for public.

9.

A directory of its officers and employees.

10.

The monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations.

11.

The budget allocated to each of its agency, indicating the particulars of all plan, proposed expenditures and reports on disbursements made.

12.

The manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes.

13.

Particulars of recipients of concessions, permits or authorizations granted by it.

14.

Details in respect of the information, available to or held by it, reduced in an electronic form.

15.

The particulars of facilities available to citizens for obtaining information including the working hours of a library or reading room, if maintained for public use.

16.

The names, designations and other particulars of the Public Information Officers.

17.

Such other information as may be prescribed.

As far as HQrs Office is concerned, the Computer Division in Hqrs. will be responsible for getting the information from the concerned Divisions of Hqrs. and placing the same on FCI Website. The ZMs/SRMs will similarly make arrangements for getting these manuals published for their Zonal/Regional/District Offices.
